Terms of Service
1. Agreement
By downloading, opening, playing, signing in to, making a purchase in, or otherwise using Smash_Bash, you agree to these Terms of Service and the Privacy Policy. If you do not agree, do not use the game. These terms apply worldwide to the maximum extent permitted by local law.
2. App Operator
Smash_Bash is operated by LemWay Prosperitas LLC, California, United States. Contact information, when required, will be provided through the App Store product page, support URL, or privacy contact listed with the app.
3. Limited License
You receive a personal, limited, revocable, non-exclusive, non-transferable license to use Smash_Bash for entertainment on devices you own or control, subject to these terms, Apple's App Store terms, and applicable law. You do not own the game, code, artwork, sounds, characters, dragons, levels, or other content.
4. Guest Play, Sign-In, and Cloud Saves
You may play as a guest or link your progress to supported sign-in providers such as Apple or Google. Guest progress may be stored only on the device and may be lost if the app is deleted, the device is reset, storage is cleared, or data becomes unavailable. Linked accounts may restore progress across reinstalls when the service is available. You are responsible for choosing the correct account and keeping your account credentials secure.
5. Progress, Coins, Lives, Boosters, and Rewards
Game progress, levels, coins, lives, boosters, dragons, daily rewards, rewarded-ad rewards, and other virtual items are for entertainment inside Smash_Bash only. They have no cash value, are not property, are not refundable unless required by law or Apple policy, and cannot be sold, transferred, exchanged, inherited, or redeemed outside the game.
6. Purchases and Billing
Real-money purchases are processed by Apple through the App Store. Prices, taxes, currency conversion, refunds, purchase history, payment authorization, and billing disputes are handled under Apple's systems and policies. Consumable purchases are intended to apply after a successful transaction is verified. If a purchase does not appear, use Apple's receipt and support tools and contact app support with reasonable details.
7. Rewarded Ads
Smash_Bash may offer optional rewarded ads, such as watching an ad for a life or another reward. Rewards may require the ad to load, play, and complete successfully. Ads may be unavailable, limited by region, consent status, network conditions, ad inventory, technical errors, or abuse prevention. Rewards, ad limits, and ad availability may change.
8. Fair Play and Prohibited Conduct
You may not cheat, exploit bugs, automate play, manipulate device time or network traffic to gain rewards, reverse engineer the app, interfere with Firebase, AdMob, StoreKit, Apple, Google, or other services, impersonate others, sell accounts or virtual items, attempt unauthorized access, or use the game in a way that harms the app, other users, services, or the operator.
9. Intellectual Property
All game content, including the Smash_Bash name, artwork, UI, boards, levels, game mechanics as expressed in the app, dragon characters, videos, sounds, music, icons, text, and software, is owned by or licensed to the operator. You may not copy, distribute, modify, sell, upload, scrape, or create derivative works from the app except where legally permitted.
10. Changes to the Game
The game is expected to evolve. Features, balance, levels, rewards, prices, ad placements, virtual item quantities, sign-in options, cloud-save behavior, and availability may be changed, paused, or removed. Updates may be required for security, compliance, compatibility, or gameplay reasons.
11. Service Availability
Smash_Bash may depend on Apple, Google, Firebase, AdMob, network connectivity, device storage, operating system features, and third-party SDKs. The game may be unavailable, interrupted, delayed, or affected by outages, maintenance, app review, policy changes, device restrictions, regional restrictions, or technical issues.
12. Children
Smash_Bash is not intended to knowingly collect personal information from children under the age required by applicable law. If you are under the age of legal consent in your region, you may use the game only with permission from a parent or legal guardian. Parents and guardians are responsible for purchases, device permissions, and account use by minors.
13. Entertainment Only
The game is provided for entertainment. It is not gambling, financial advice, medical advice, legal advice, education certification, or a guarantee of any result. Virtual rewards and progression are gameplay features only and have no real-world monetary value.
14. No Warranty
To the maximum extent permitted by law, Smash_Bash is provided as is and as available, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or error-free operation.
15. Limitation of Liability
To the maximum extent permitted by law, the operator will not be liable for indirect, incidental, special, consequential, punitive, exemplary, or lost-profit damages; loss of data, progress, rewards, virtual items, goodwill, or device use; or claims arising from outages, ads, purchases, account mistakes, third-party services, or gameplay. Where liability cannot be excluded, it is limited to the amount you paid for the app or in-app purchases in the previous six months, or the smallest amount allowed by law.
16. Your Responsibility
You agree to be responsible for losses, claims, damages, liabilities, and expenses arising from your misuse of the app, violation of these terms, violation of law, unauthorized account activity, cheating, abuse of services, or infringement of another person's rights, to the extent permitted by law.
17. Governing Law and Disputes
Except where local consumer law gives you mandatory rights that cannot be waived, these terms are governed by the laws of California, United States, without regard to conflict-of-law rules. You and the operator will first try to resolve disputes informally through app support. Some regions may require different dispute rights, venues, refund rules, or consumer protections, and those mandatory rights still apply.
18. Suspension or Termination
The operator may suspend, limit, reset, or terminate access to features, cloud saves, rewards, or accounts if required for security, fraud prevention, legal compliance, service integrity, or violation of these terms. You may stop using the game at any time by deleting it from your device.
19. Updates to Terms
These terms may be updated as the game, laws, store requirements, or services change. If a material update is made, the app may ask you to accept the new version before continuing. Continued use after an update means you accept the updated terms.
